Parking Rules of Montclair Townhomes
Vehicles may be subject to enforcement for the following violations:
- vehicle parked in fire lane(s)
- vehicle with NO license plate displayed
- vehicle with an expired registration decal (yellow sticker on license plate)
- backed into parking space
- commercial vehicles are prohibited after 8PM
- inoperable vehicles (Flat tire(s), broken window, oil leaks, etc.)
- vehicle parked while blocking other vehicles
- parked In (Marked Area) "No Parking"
- any vehicle parked on a driveway with less than 75% of the vehicle on the driveway.
- any vehicle blocking the road, ingress/egress points, or sidewalks.
- any vehicle in violation of any other State/County/City law, regulation, or rule.
- resident vehicles parked in guest parking spots after 6 PM and before 6 AM on weekdays and any time on weekends.
- any guest vehicle not registered for visitation by the owner/tenant.
- any vehicle parked against flow of traffic.
- vehicle Registration declined.
- guest permit/registration expired.
DMA360 Parking Enforcement & Account Responsibility Policy
This policy explains the responsibilities of account holders, the role of DMA360, enforcement escalation procedures, and the consequences associated with parking violations on the property.
1. Resident & Account Holder Responsibility
All residents and account holders are fully responsible for any vehicles registered under their account, including guest vehicles.
This responsibility includes, but is not limited to:
- Parking violations
- Misuse of guest passes
- Non-compliance with property parking rules
- Any actions taken by guests while on the property
The account holder accepts full accountability for all activity associated with their account and registered vehicles.
2. Guest Vehicle Accountability
By registering a guest vehicle, the account holder acknowledges and agrees that:
- They are fully responsible for the guest vehicle and its compliance with property rules
- Any violations incurred by a guest vehicle will be attributed to the account holder
- Repeated or severe violations may impact the account holder’s access to the system
3. DMA360 Role in Enforcement
DMA360 provides a digital platform and operational support for parking compliance.
DMA360 is responsible for:
- Conducting routine patrols to identify parking violations
- Documenting violations with supporting evidence, including photos, timestamps, and location data
- Determining whether enforcement action is warranted based on property rules
- Authorizing a designated enforcement company to carry out enforcement actions
- Managing account status, including restrictions, suspensions, and reinstatements
DMA360 serves as the administrative authority for identifying violations and authorizing enforcement actions but does not physically perform enforcement actions.
4. Enforcement Execution
All physical enforcement actions are performed solely by the designated enforcement company.
This includes:
- Placement and removal of enforcement devices, including boots or immobilizers
- Vehicle towing
- On-site enforcement activity
DMA360 does not physically perform enforcement actions and is not responsible for how enforcement actions are carried out.
5. Financial Responsibility & Enforcement Fees
All fines, fees, and costs associated with enforcement actions are managed by the enforcement company and/or property management.
DMA360 does not:
- Set or determine enforcement pricing
- Collect fines or payments
- Reimburse fines or payments
- Handle billing disputes related to enforcement actions
All payment obligations and disputes must be resolved directly with the enforcement provider.
6. Enforcement Escalation
Violations of parking rules may result in enforcement actions, including the application of an enforcement device.
Any removal, damage, or tampering with an enforcement device is considered a severe violation.
Severe violations will result in:
- Towing of the vehicle at the owner’s expense
- Immediate suspension of the associated account
- Banning of the vehicle from the property
Vehicles banned from the property are not permitted to return under any circumstances unless explicitly approved.
7. Grace Period for Force Shield Users
Force Shield users, and approved guest vehicles when applicable, will be granted a limited grace period to resolve violations prior to enforcement.
During this period:
- The user will be notified of the violation
- A 30-minute time window will be provided to correct the issue
Failure to resolve the violation within the allotted time will result in standard enforcement actions.
Severe violations are not eligible for any grace period.
8. Account Suspension & Restrictions
DMA360 reserves the right to restrict or suspend account access under the following conditions:
- Severe violations, including but not limited to enforcement device tampering
- Repeated non-compliance with parking rules
- Abuse or misuse of the guest registration system
- Failure to maintain active account status, including non-payment
Account access may remain restricted until the issue has been resolved with the enforcement provider or property management.
9. Vehicle Bans
Vehicles may be banned from the property for:
- Severe violations
- Repeated non-compliance
- Fraudulent or misleading registration
- Reckless driving on property
- Tailgating onto the property
A banned vehicle is not permitted on the property under any circumstances unless explicitly approved.
10. Reinstatement of Access
To restore account access or remove restrictions, the account holder must:
- Resolve all outstanding violations directly with the enforcement provider
- Comply with all property parking policies
- Receive approval for reinstatement, if applicable
DMA360 reserves the right to review each case prior to restoring access.
11. Limitation of Responsibility
DMA360 acts as a platform and administrative authority for parking compliance.
DMA360 is not responsible for:
- The execution of physical enforcement actions
- Damages resulting from enforcement actions
- Disputes between residents and enforcement personnel
- Financial transactions related to enforcement
Any issues related to enforcement execution must be directed to the enforcement provider.
12. Policy Acknowledgment
By using the DMA360 system, registering a vehicle, or issuing a guest pass, the account holder acknowledges and agrees to this policy and accepts full responsibility for all associated activity.
